01Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and JCS Marketing, Inc., a California corporation ("JCS," "we," "us," or "our"). By accessing or using jcsmarketinginc.com (the "Site"), subscribing to a JCS publication, registering for a JCS event, opting in to our SMS program, or engaging our agency services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms, do not use the Site or our services.

02Eligibility
You must be at least eighteen (18) years old to use the Site and to register for our services, subscriptions, or events. Individuals under 18 may use the Site only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf. By using the Site, you represent that you meet these requirements and that you have the legal authority to enter into these Terms.
03Definitions
- Site — the website located at jcsmarketinginc.com and any associated pages or subdomains we designate as subject to these Terms.
- Services — the features, content, publications, events, subscriptions, SMS program, agency services, and related offerings made available by JCS.
- Content — all articles, photographs, illustrations, video, audio, layouts, software, logos, trademarks, designs, and other material made available on the Site or through our Services.
- User Content — any information, text, photographs, files, inquiries, pitches, letters, or other material you submit to JCS through the Site or otherwise.
04Our Content & Intellectual Property
The Site and all Content — including articles published in West Coast Nut, Progressive Crop Consultant, Enterprise Ag Magazine, and on MyAgLife; photographs, video, and audio recordings; event programming and materials; and the visual design and code of the Site — are owned by JCS or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. This license does not include any right to:
- Reproduce, republish, redistribute, or reprint any Content in whole or in part without our prior written permission;
- Create derivative works from any Content;
- Use any Content for commercial purposes, including using photographs or article excerpts in marketing materials, sales collateral, presentations, or third-party publications;
- Scrape, data-mine, or otherwise extract Content in bulk;
- Use our name, logos, or marks in a way that suggests endorsement or affiliation without our prior written consent; or
- Remove or alter any copyright, trademark, or other proprietary notices.

05Trademarks
"JCS Marketing," "West Coast Nut," "Progressive Crop Consultant," "Enterprise Ag," "Enterprise Ag Magazine," "MyAgLife," "Almond Day," "Pistachio Day," "Agri-Marketing Conference," "Crop Consultant Conference," "Enterprise Ag Summit," and related logos and designs are trademarks of JCS Marketing, Inc. Nothing on the Site grants you any right or license to use any of these marks. All other trademarks referenced are the property of their respective owners.
06User Submissions
When you submit User Content to us — including inquiries, comments, pitches, photographs, letters to the editor, press releases, event feedback, or any other material — you grant JCS a non-exclusive, worldwide, royalty-free, sublicensable, transferable, and irrevocable license to use, copy, modify, publish, distribute, display, and create derivative works of that material in connection with our publications, events, marketing, and archives, in any media now known or later developed.
You represent and warrant that:
- You own or have the necessary rights to the User Content you submit;
- The User Content does not violate the rights of any third party, including copyright, trademark, publicity, privacy, or other rights;
- The User Content is accurate and not misleading; and
- Your submission does not violate any applicable law.
We are under no obligation to publish, respond to, return, or compensate you for any User Content. We reserve the right to remove or decline to publish any User Content for any reason.
07Subscriptions
Subscriptions to our print magazines and email newsletters are governed by these Terms and by any additional subscription terms presented at signup. Key points:
- Eligibility. Subscriptions to controlled-circulation publications (such as West Coast Nut and Progressive Crop Consultant) may be limited to qualified industry participants; we may verify your qualification before starting or renewing a subscription.
- Changes of address and updates. You are responsible for keeping your mailing address, email, and qualification details current. Contact info@jcsmarketinginc.com to update your record.
- Unsubscribing. You can unsubscribe from email newsletters by clicking the "unsubscribe" link at the bottom of any newsletter, or by emailing info@jcsmarketinginc.com. Print-subscription cancellations must be requested by email or phone.
- Paid subscriptions. Where a subscription is paid, fees are non-refundable except where required by law. Subscription terms, renewal dates, and cancellation windows will be disclosed at the point of purchase.
08Events
Registration for JCS events — including Almond Day, Pistachio Day, the Agri-Marketing Conference, the Crop Consultant Conference, and the Enterprise Ag Summit — is currently handled through MyAgLife and our media-kit commerce system. Registration for each event is subject to these Terms plus any event-specific terms presented at checkout. Key points:
- Registration confirmation. Your registration is confirmed once payment has been received (where applicable) and we send a confirmation email. JCS reserves the right to refuse or cancel any registration for any reason not prohibited by law.
- Cancellations and refunds. Cancellation and refund policies are disclosed at the time of registration and vary by event. Absent specified terms, paid registrations are non-refundable within thirty (30) days of the event.
- Event changes, postponements, or cancellations. JCS may change the date, venue, speakers, program, or format of any event, or cancel the event entirely, for operational, health, safety, or other reasons. In the case of cancellation by JCS, we will follow the refund policy disclosed at registration or, if none, provide credit toward a future JCS event.
- Code of conduct. Attendees, exhibitors, sponsors, speakers, and guests must treat one another with professionalism and respect. Harassment, discrimination, threats, and disruptive behavior are prohibited. JCS may remove anyone in violation without refund.
- Photography, video, and audio release. By attending a JCS event, you grant JCS and its authorized photographers, videographers, and press partners the irrevocable right to photograph, film, and record you (including your image, voice, and likeness) and to use those recordings in JCS publications, marketing, event promotion, archives, and partner media, in any format and in perpetuity, without further notice or compensation. If you do not wish to be recorded, please inform the JCS registration desk on arrival; we will make reasonable efforts to accommodate you, but we cannot guarantee you will not appear in crowd or panoramic shots.
- Exhibitors and sponsors. Exhibitor and sponsor arrangements are governed by separate written agreements that control over these Terms in the event of any conflict.
- Force majeure. JCS is not liable for failure to perform event obligations due to causes beyond our reasonable control, including natural disasters, pandemics, governmental actions, venue closures, labor disputes, utility failures, and acts of war or terrorism.
09SMS & Text Messaging
Our SMS program lets subscribers receive text messages from JCS. Participation is voluntary and requires your explicit opt-in. Full details — including program name, message types, frequency, and the phone number from which we send — are set forth in our Privacy Policy, Section 11. Key points incorporated into these Terms:
- You must be the account holder of the mobile number you provide, or have permission from the account holder to enroll.
- You consent to receive SMS messages at the number you provide, including messages sent via automated dialing systems. Consent is not a condition of purchase.
- You can stop receiving messages at any time by replying STOP. Reply HELP for help. Standard message and data rates may apply.
- Mobile carriers are not liable for delayed or undelivered messages.
- JCS does not share phone numbers or SMS opt-in data with third parties or affiliates for marketing purposes.
- If you change or deactivate the mobile number associated with your opt-in, notify us promptly at info@jcsmarketinginc.com so we can update our records.
10Acceptable Use
You agree not to, and not to permit any third party to:
- Use the Site or Services for any unlawful purpose or in violation of these Terms;
- Use robots, crawlers, spiders, scrapers, or other automated means to access, collect, or extract data from the Site or Services, except for public search engines operating within industry norms;
- Harvest or collect personal information about other users, advertisers, event attendees, or JCS personnel from the Site;
- Reverse-engineer, decompile, or disassemble any portion of the Site or Services, except to the extent expressly permitted by applicable law;
- Interfere with or disrupt the Site, the Services, or any servers or networks connected to them, including by introducing viruses, worms, or other malicious code;
- Attempt to circumvent rate limits, security controls, CAPTCHA, anti-bot, or other access-control measures;
- Impersonate any person or entity, misrepresent your affiliation, or forge headers or identifiers;
- Use the Site or Services to send unsolicited communications, spam, or junk mail; or
- Republish, mirror, frame, or resell any Content without our express written permission.
We may investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section — including removing content, suspending or terminating access, and cooperating with law enforcement.
11Editorial Disclaimer
Content published by JCS — including articles on agronomic practices, crop management, pest and disease pressure, regulatory updates, market conditions, equipment, and input products — is provided for general informational and educational purposes only and reflects the views of the authors, editors, and sources quoted. It is not professional agronomic, regulatory, legal, financial, tax, investment, or medical advice, and it is not a substitute for consultation with a licensed Pest Control Adviser (PCA), Certified Crop Adviser (CCA), attorney, accountant, financial advisor, or other qualified professional.
Agricultural conditions vary widely by crop, region, season, and operation. Application rates, cultural practices, and treatment regimens described in our Content may not be appropriate for your specific circumstances. Always consult your licensed PCA or CCA, follow product labels, and comply with all applicable federal, state, and county regulations before implementing any recommendation. JCS disclaims all liability for actions taken or not taken based on any Content.
12Advertisers & Editorial Independence
JCS publishes advertising, sponsored content, and paid promotional messages. Paid content is clearly labeled as such. Advertising does not influence our editorial decisions. The appearance of any advertisement, sponsorship, or endorsement is not a representation or warranty by JCS regarding the advertiser's products or services. Your dealings with advertisers are solely between you and the advertiser, and JCS is not responsible for any loss or damage resulting from those dealings.
13Third-Party Sites & Services
The Site contains links to third-party websites, services, and resources that are not owned or controlled by JCS. These links are provided for convenience only. JCS does not endorse, monitor, or verify any third-party site and is not responsible for its content, availability, accuracy, or privacy practices. Your use of any linked site is at your own risk and is governed by that site's terms and privacy policy.
14Disclaimer of Warranties
THE SITE, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. JCS DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE, RELIABLE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS; TO THE EXTENT THOSE LAWS APPLY, THE DISCLAIMERS ABOVE MAY NOT APPLY TO YOU.
15Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JCS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOST CROP YIELDS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, CONTENT, OR SERVICES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF JCS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
JCS'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO JCS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES; TO THAT EXTENT, THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU.
16Indemnification
You agree to indemnify, defend, and hold harmless JCS and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Site, Content, or Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any User Content you submit.
17DMCA Copyright Policy
JCS respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"), JCS will respond to notices of alleged copyright infringement that comply with applicable law.
Filing a Notice of Alleged Infringement
If you believe Content on the Site infringes a copyright you own or are authorized to act on behalf of, please send a written notice to our designated agent that includes:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it (including a URL);
- Your contact information — name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notice
If you believe Content was removed or access to it was disabled in error, you may send a counter-notice to our designated agent containing the information required by 17 U.S.C. § 512(g), including your name and contact information, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification, and your consent to the jurisdiction of the federal district court for the district in which you reside (or, if outside the U.S., the Eastern District of California).
Repeat Infringer Policy
JCS will, in appropriate circumstances, terminate the access of Users or account holders who are repeat infringers.
Note: The effectiveness of the DMCA safe harbor requires JCS to register its designated agent with the U.S. Copyright Office. Registration is separate from the posting of this policy and must be completed at dmca.copyright.gov.
18Governing Law
These Terms and any dispute or claim arising out of or related to them, the Site, or the Services are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
19Disputes & Venue
Except for claims that qualify for small claims court (see below), any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or the Services shall be brought exclusively in the state or federal courts located in Fresno County, California. You and JCS each consent to the personal jurisdiction of those courts and waive any objection to venue in those courts.
Small Claims Carve-Out
Notwithstanding the preceding paragraph, either party may bring a qualifying individual claim in a small claims court in Fresno County, California, so long as the claim remains on an individual (non-class, non-representative) basis and stays in that court.
Informal Resolution
Before filing any formal action, you agree to first contact JCS at info@jcsmarketinginc.com and give us at least thirty (30) days to attempt to resolve the dispute informally. This requirement does not limit your ability to bring a small claims action or to seek injunctive relief where appropriate.
Time Limit
Any claim arising out of or related to these Terms, the Site, or the Services must be brought within one (1) year after the claim accrues; otherwise, the claim is permanently barred.
20Termination
We may suspend or terminate your access to the Site or Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. On termination, the provisions of these Terms that by their nature should survive — including intellectual property, user submissions, acceptable use, editorial disclaimers, warranty disclaimers, limitation of liability, indemnification, governing law, disputes, and general provisions — will continue to apply.
21General Provisions
- Entire agreement. These Terms, together with our Privacy Policy and any additional terms presented for specific services, constitute the entire agreement between you and JCS regarding the Site and Services.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms without our prior written consent. JCS may assign these Terms freely.
- No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
- Notices. Notices to JCS should be sent to info@jcsmarketinginc.com or the address in Section 23. Notices to you may be sent to the email address associated with your subscription or registration, or posted on the Site.
- Headings. Section headings are for convenience only and have no legal effect.
22Changes to Terms
We may modify these Terms from time to time. If we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice (such as a banner on the Site or an email to subscribers). Your continued use of the Site or Services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, stop using the Site and Services.
