01Introduction
JCS Marketing, Inc. ("JCS," "we," "us," or "our") respects your privacy. This Privacy Policy describes the categories of personal information we collect, how we use and share it, the choices you have, and how we comply with applicable privacy laws — including the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, "CCPA/CPRA"), the California Online Privacy Protection Act ("CalOPPA"), the Children's Online Privacy Protection Act ("COPPA"), and the Telephone Consumer Protection Act and industry A2P 10DLC standards that govern SMS messaging.
By using the Site, subscribing to our publications, registering for an event, or otherwise engaging with JCS, you acknowledge that you have read and understood this Policy.

JCS Marketing, Inc. is a California corporation and the publisher of West Coast Nut, Progressive Crop Consultant, and Enterprise Ag Magazine; the operator of digital platforms and podcasts under the MyAgLife brand; and the producer of Almond Day, Pistachio Day, the Agri-Marketing Conference, the Crop Consultant Conference, the Enterprise Ag Summit, and other California agriculture industry events.

JCS Marketing, Inc. is the "business" responsible for the personal information collected through the Site for purposes of the CCPA/CPRA.
03Scope of This Policy
This Policy applies to personal information collected through jcsmarketinginc.com and related pages. Our partner and sister properties — including myaglife.com, wcngg.com, progressivecrop.com, event registration sites hosted by third parties, and the JCS media kit store — may operate under their own privacy policies. When you leave the Site through a link, the destination site's privacy practices apply to your visit there.
04Information We Collect
We collect personal information in three ways:
A. Information You Provide Directly
When you fill out an inquiry form, subscribe to a newsletter, request a media kit, submit a pitch or letter to the editor, or otherwise contact us, we collect the information you choose to provide. This typically includes:
- First and last name
- Email address
- Company or farm name
- Inquiry type (e.g., advertising, agency services, subscription, press)
- The content of your message
- Phone number (only when you provide it, including when you opt in to receive SMS/text messages — see Section 11)
- Mailing address (for print-magazine subscribers)
B. Information Collected Automatically
When you visit the Site, we and our service providers collect certain information automatically, including:
- IP address — used to limit abusive form submissions (our inquiry form enforces a per-IP rate limit) and included in the server-side records of inquiries you send us.
- Browser and device information — browser type, operating system, screen size, language, and general device category.
- Usage information — pages visited, referring URL, time spent, clicks, and scroll depth — collected through Google Tag Manager and any analytics tags loaded through it (such as Google Analytics).
- Approximate geolocation — inferred from your IP address at the city or regional level. We do not collect precise GPS location.
- Cookies and similar technologies — see Section 7.
C. Information From Third-Party Sources
If you subscribe to a JCS publication or register for a JCS event through a partner platform (for example, our MyAgLife subscription system, our event registration providers, or our media kit store), we receive your contact information and subscription/registration details from that platform. We may also receive business-contact information from trade-show sponsors, advertisers, industry associations, and publicly available sources to support editorial and advertising outreach.
05How We Use Information
We use personal information for the following business purposes:
- Respond to inquiries — answer questions about advertising rates, agency services, subscriptions, events, and editorial matters.
- Fulfill subscriptions — ship print magazines, deliver email newsletters, and manage renewals.
- Register and service events — confirm registrations, send event logistics and reminders, and facilitate check-in.
- Send relevant communications — editorial updates, industry news, event invitations, advertising opportunities, and administrative messages. You may unsubscribe at any time.
- Send SMS messages — only to recipients who have opted in (see Section 11).
- Operate and improve the Site — measure usage, diagnose technical problems, and improve design and content.
- Prevent abuse and secure the Site — enforce rate limits, block spam, and investigate suspected violations of our Terms.
- Comply with legal obligations — including tax, accounting, and subpoenas or other lawful requests.
- Advertising and agency services — for clients of our marketing agency, manage campaigns in accordance with our separate client agreements.
06How We Share Information
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under the CCPA/CPRA. We share personal information only as described below:
- Service providers. We use third-party companies to host the Site, deliver email, process event registrations and subscriptions, and provide analytics. These providers are contractually limited to using the information only to perform services for JCS. Current categories of providers include our web host (DreamHost), email delivery, Google (via Google Tag Manager and, where used, Google Analytics), our subscription platform (MyAgLife), our event-registration and media-kit commerce systems, and our SMS messaging provider.
- Legal and safety. We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, the safety of others, or to investigate fraud.
- Business transfers. If JCS is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, personal information may be transferred as part of that transaction. We will notify affected individuals through this Policy or by email if the transfer materially changes how their information is handled.
- With your consent. We may share information with other parties when you explicitly ask us to or direct us to.
07Cookies & Tracking Technologies
Cookies are small text files a website places on your device. Similar technologies include pixels, local storage, and tags. We and our service providers use these technologies to make the Site work, remember your preferences, and measure how the Site is used.
Categories of Cookies We Use
- Strictly necessary — required for basic Site function (e.g., serving pages, submitting forms, security).
- Analytics and performance — primarily Google Tag Manager and analytics tags loaded through it. These help us understand which articles, events, and services are of interest and how to improve the Site.
- Functional — remember preferences such as recently viewed content.
Your Choices
Most browsers let you block or delete cookies through your browser settings. Blocking strictly necessary cookies may cause parts of the Site to stop working. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.
Do Not Track ("DNT") Signals
Some browsers send a "Do Not Track" signal to websites you visit. There is no consistent industry standard for how websites must respond to DNT signals, and we do not currently respond to them. We do honor the Global Privacy Control ("GPC") signal where applicable as a valid opt-out of sale/share for residents of jurisdictions that recognize it.
08Your California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act.
Categories of Personal Information We Collect
In the past twelve (12) months, JCS has collected the following categories of personal information described in California Civil Code §1798.140:
- Identifiers — name, email, phone number (when provided), postal address, IP address.
- Customer records (as defined in Cal. Civ. Code §1798.80(e)) — company/farm name, job title, and similar business-contact information.
- Commercial information — subscriptions held, events registered for, advertising inquiries, products or services considered.
- Internet or other electronic network activity — browsing and usage information on the Site, pages viewed, referring URL.
- Geolocation data — approximate (city/region level) inferred from IP address. No precise geolocation.
- Inferences — drawn from the categories above to help us understand which content and offers may be relevant.
We do not knowingly collect "sensitive personal information" as that term is defined by the CCPA/CPRA (such as Social Security numbers, government IDs, precise geolocation, account login credentials, financial account numbers, health or biometric data, or genetic data) through the Site.
Sources of Personal Information
We collect personal information directly from you; automatically when you use the Site (see Section 4.B); from our service providers and publication/event platforms; and from public and industry sources.
Business & Commercial Purposes
We use personal information for the purposes described in Section 5. These map to the CCPA/CPRA business purposes of providing goods or services, managing our interactions with you, security and fraud prevention, analytics, quality and safety, advertising and marketing of our own products, and internal research.
Categories of Third Parties With Whom We Share Information
Service providers (hosting, email, analytics, subscription, event, SMS); legal authorities when required; and successors in a business transfer. See Section 6 for detail.
Sale and Sharing
JCS does not sell personal information and does not share personal information for cross-context behavioral advertising.
Your California Rights
- Right to know — request the specific pieces of personal information we have collected about you, the categories, the sources, the purposes, and the categories of third parties to whom we disclosed it, for the preceding 12 months.
- Right to delete — request deletion of personal information we have collected from you, subject to legal exceptions.
- Right to correct — request that we correct inaccurate personal information we maintain about you.
- Right to opt out of sale or sharing — we do not sell or share, so this right is effectively satisfied by default. You may still submit a request to confirm.
- Right to limit use of sensitive personal information — we do not use sensitive personal information for purposes that would trigger this right.
- Right to non-discrimination — we will not deny you goods or services, charge different prices, or provide a lesser quality of service because you exercised any of these rights.
How to Submit a Verifiable Consumer Request
Email info@jcsmarketinginc.com with the subject line "California Privacy Request" or call 559-352-4456. Tell us which right you are exercising. We will verify your identity by matching the information you provide against information we already hold. We may request additional information to confirm your identity before responding. Making a request does not require you to create an account with us.
Authorized Agents
You may designate an authorized agent to submit a request on your behalf. We will require written proof of the agent's authority (such as a signed power of attorney or a signed authorization) and will verify your identity directly before acting on the request.
Response Timeline
We will confirm receipt of your request within ten (10) business days and respond substantively within forty-five (45) calendar days. We may extend the response period by an additional forty-five (45) days where reasonably necessary and permitted by law, in which case we will notify you of the extension and the reason.
09Shine the Light (Cal. Civil Code §1798.83)
California residents may request a list of third parties to whom JCS has disclosed personal information for those parties' direct-marketing purposes in the preceding calendar year. JCS does not currently share personal information with third parties for their own direct-marketing purposes. To confirm, or to submit a Shine the Light request, email info@jcsmarketinginc.com with "Shine the Light Request" in the subject line.
10CalOPPA Disclosures
The California Online Privacy Protection Act requires the following statements:
- You can review and request changes to your personal information by contacting us at info@jcsmarketinginc.com.
- We notify users of changes to this Policy by posting a revised version on this page and updating the "Last Updated" date (see Section 17).
- As noted in Section 7, we do not respond to Do Not Track signals. We honor Global Privacy Control signals where applicable.
- Third parties may collect personally identifiable information about your online activities over time and across different websites when you use the Site, through analytics tags loaded via Google Tag Manager.
11SMS & Text Messaging (A2P 10DLC)
JCS sends SMS/text messages to recipients who have expressly opted in. This section explains how our SMS programs work and your rights under the Telephone Consumer Protection Act and applicable A2P 10DLC carrier rules.

Opt-In
We send SMS messages only to phone numbers whose owners have explicitly consented — by checking a clearly labeled opt-in box on a form, replying with a specified keyword, or providing equivalent written authorization. Your phone number is never added to an SMS list automatically or as a condition of purchasing any product or service.
Opt-Out
You can stop receiving SMS messages at any time by replying STOP to any message we send. After you reply STOP, we will send one confirmation message and will not send additional SMS messages to that number unless you opt back in. To resume messages, reply START. For assistance, reply HELP or email info@jcsmarketinginc.com.
Cost
Message and data rates may apply depending on your mobile plan. JCS does not charge you for the messages themselves.
Carrier Disclaimer
Mobile carriers are not liable for delayed or undelivered messages. Delivery may be affected by factors outside our control.
Sharing of Phone Numbers and Opt-In Data
We do not share phone numbers or SMS opt-in data with third parties or affiliates for the purpose of marketing or promotion. We share these data only with the SMS provider we use to transmit messages and only for that purpose, and as otherwise required by law. This restriction applies to every JCS SMS program and is not limited to the current program configuration.
Supported Carriers
Major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, and their MVNOs. Support may be limited on some prepaid and MVNO plans.
12Children's Privacy
The Site is directed to adult professionals in the agriculture industry. We do not knowingly collect personal information from children under the age of 13. If you believe a child has provided personal information to us, please contact info@jcsmarketinginc.com and we will delete it promptly.
13Other U.S. State Privacy Rights
Residents of certain other U.S. states — including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and others — have rights under their state privacy laws that are generally similar to those described in Section 8 (access, correction, deletion, portability, and opt-out of targeted advertising, sale, or profiling). JCS does not engage in targeted advertising, sale, or profiling as those terms are typically defined. To exercise a state privacy right, contact info@jcsmarketinginc.com and identify the state law under which you are submitting the request. We will verify your identity and respond within the timeframe required by your state's law.
14Data Security & Retention
We use reasonable administrative, technical, and physical safeguards to protect personal information, including TLS encryption in transit, access controls that limit employee access to personal information on a need-to-know basis, and vendor agreements that require service providers to handle information securely. No method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
We retain personal information for as long as needed to fulfill the purposes for which it was collected, including to respond to inquiries, maintain subscriptions, manage event attendance, comply with tax and accounting obligations, and resolve disputes. Inquiry records and rate-limiting logs are typically retained for up to twenty-four (24) months. Subscription records are retained for the duration of your subscription plus the period required by California tax law. SMS opt-in records are retained for as long as you remain subscribed plus a reasonable period to demonstrate consent in case of dispute.
15International Users
The Site is operated from the United States. If you access the Site from outside the U.S., be aware that your information will be transferred to, stored, and processed in the U.S. By using the Site, you consent to the transfer of your information to the United States. JCS does not target the Site to users in the European Economic Area, the United Kingdom, or other non-U.S. jurisdictions.
16Third-Party Links
The Site contains links to third-party websites — including social-media profiles, partner publications, the MyAgLife platform, event registration and media-kit commerce sites, and external advertisers. We are not responsible for the privacy practices of those sites. We encourage you to review their privacy policies before providing any information.
17Changes to This Policy
We may update this Policy from time to time. When we do, we will change the "Last Updated" date at the top of the page. If the changes are material, we will provide more prominent notice — for example, a banner on the Site or an email to subscribers. We encourage you to review this Policy periodically to stay informed about how we protect your information.
